This agreement explains the risks involved with travel and participation in activities arranged or facilitated by Destination & Travel Junkies. While some trips are not adventure-based, all travel involves everyday risks such as walking, transportation, weather conditions, and unfamiliar environments. Please review this document carefully. You will be asked to confirm that you have reviewed and agreed to these terms before participating in travel arranged by Destination & Travel Junkies.

Governing Law:
This agreement is governed by the laws of the State of Georgia.

How This Agreement Is Used
This agreement is reviewed on this website and acknowledged through a secure electronic form prior to travel. Travelers will be required to confirm that they have reviewed this agreement and to provide an electronic signature before departure.

1. Participant Information (Reference)

This agreement applies to the traveler signing the electronic acknowledgment and signature form associated with this document (“Participant”).

2. Acknowledgment of Risks

I understand that travel and recreational activities involve inherent risks, including risks that may cause injury, illness, property damage, emotional distress, permanent disability, or death, even when safety precautions are taken.

These risks may include, but are not limited to, participation in activities such as:

  • Weathr

  • Walking in unfamiliar environments (uneven sidewalks, curbs, stairs)

  • Transportation by air, land, or sea (including buses, vans, taxis, boats, and flights)

  • Swimming (ocean, beach, pool)

  • Snorkeling

  • Scuba diving

  • Parasailing

  • Zip lining

  • Boat excursions and water sports

  • Adventure, cultural, and recreational activities

  • Hotel, lodging, and public facility use

I understand that risks may arise from, including but not limited to:

  • Weather, ocean conditions, and environmental hazards

  • Equipment malfunction or failure

  • Acts or omissions of third-party providers

  • Acts of nature or unforeseen circumstances

  • My own actions, decisions, or physical condition

  • Actions of other travelers or members of the public

3. Voluntary Participation & Health Representation

I confirm that:

  • I am participating voluntarily

  • I am responsible for knowing my own limits and choosing whether to participate in any activity

  • I am in good physical and mental health and able to participate safely, or I have consulted a medical professional as needed

  • I may choose not to participate in any activity at any time

I understand that Destination & Travel Junkies does not provide medical advice, and it is my responsibility to consult a healthcare provider regarding any medical concerns, conditions, or limitations.

4. Assumption of Risk

I knowingly, freely, and voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable, associated with travel and activities related to this trip, including risks that may arise from the negligence of others, except where prohibited by law.

5. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless:

Destination & Travel Junkies, its owners, agents, employees, trip hosts, contractors, affiliates, and representatives from any and all claims, demands, losses, damages, costs, or legal actions arising out of or related to my participation in travel or activities, including but not limited to claims related to:

  • Personal injury

  • Illness

  • Property damage or loss

  • Emotional distress

  • Permanent disability

  • Death

6. Third-Party Service Providers

I understand that activities, accommodations, transportation, and excursions may be provided by independent third-party suppliers. I understand that Destination & Travel Junkies does not own, operate, or control these suppliers.

I acknowledge that:

  • Each supplier may require their own waiver, which I agree to sign

  • Destination & Travel Junkies is not responsible for the acts, omissions, or negligence of any third-party provider

7. Indemnification

I agree to indemnify and hold harmless Destination & Travel Junkies from any claims, damages, losses, liabilities, costs, or legal expenses (including attorney fees) arising from:

  • My participation in travel or activities

  • My actions, conduct, or decisions

  • Any breach of this agreement

8. Insurance Recommendation

I acknowledge that I have been strongly encouraged to purchase travel insurance, including coverage for medical expenses, emergency evacuation, trip interruption, and trip cancellation.

I understand that Destination & Travel Junkies is not an insurance provider and does not sell or underwrite insurance policies. Destination & Travel Junkies may refer travelers to third-party insurance providers for convenience, but makes no representations or guarantees regarding coverage, benefits, or claims.

I understand that it is my responsibility to review insurance options and determine what coverage is appropriate for my needs.

9. Governing Law & Venue (Georgia)

This agreement is governed by the laws of the State of Georgia, because Destination & Travel Junkies is based in Georgia.

Any legal claim, dispute, or lawsuit related to this agreement or to travel arranged by Destination & Travel Junkies must be brought and handled in the State of Georgia, regardless of where the traveler lives.

10. Severability

If any part of this agreement is found to be invalid or unenforceable under Georgia law, the rest of the agreement will still apply and remain in full force and effect.

11. Acknowledgment of Understanding

By signing the electronic waiver acknowledgment form, I confirm that:

  • I have had the opportunity to review this agreement in full

  • I have read and understand this entire agreement

  • I understand that I am giving up certain legal rights

  • I agree to these terms, and I am signing the agreement freely and voluntarily

  • I am 18 years of age or older, or I am the legal guardian signing on behalf of a minor

12. Participation Requirement

Completion of the electronic waiver acknowledgment is required to participate in travel arranged by Destination & Travel Junkies.

Minors (Under Age 18)

Destination & Travel Junkies does not permit minors to participate in hosted group trips.

For custom or family travel (FIT bookings) where minors may be included, the following applies:

If the traveler is under the age of 18, this agreement must be reviewed and signed by the minor’s parent or legal guardian. By signing on behalf of a minor, the parent or legal guardian agrees to all terms of this agreement and assumes full responsibility for the minor’s participation, conduct, supervision, and safety during travel.
